Korean Appeals against Final Rejection: Key Points

Two Routes after a Decision of Rejection

In Korea, a final rejection is a decision of rejection issued by the examiner. Within three months of receiving it, the applicant may either request re-examination with an amendment (Patent Act, Article 67-2) or file an appeal with the Korean Intellectual Property Trial and Appeal Board (Article 132-17). Re-examination returns the application to the examiner with amended claims and is often efficient when a narrower claim would overcome the cited art. An appeal asks the Board to review the examiner's reasoning and suits cases in which the applicant considers the rejection wrong on the existing claims. Once an appeal has been filed, re-examination is no longer available unless the Board sets aside the decision of rejection (Article 67-2(1)(ii)).

Deadlines, Extensions, and Divisional Filings

The three-month period runs from service of the decision of rejection. On request, the period for filing the appeal may be extended once by up to 30 days (Article 15(1)), and the re-examination and divisional filing windows follow that extended period (Articles 67-2(1) and 52(1)(ii)). A divisional application filed within the same window allows the applicant to pursue an appeal on one claim set while preserving other subject matter in a separate application. Because these windows overlap, the choice of route, the claim sets, and any divisional filing should be decided together, well before the deadline, so that translations and instructions can be finalized in time.

If the Board Dismisses the Appeal

If the Board upholds the rejection, the applicant may file an action with the Patent Court of Korea within 30 days of service of the trial decision (Article 186(3)). In these ex parte cases, the defendant is the head of MOIP, the Korean patent office (Article 187). Korean law also allows a separation application: within the same 30-day period, the applicant may file a new application limited to claims that were not rejected in the decision of rejection, or to rejected claims amended in limited ways (Article 52-2). This option can secure allowable claims while the main dispute continues, so it should be assessed as soon as the Board's decision is received.

Key Issues We Review

  • Appeal grounds based on the examiner's final reasoning and prior response history.
  • Availability and strategic value of claim amendments.
  • Technical distinctions over cited references and support in the specification.
  • Coordination with foreign prosecution and commercial portfolio goals.

Documents and Information to Send

  • Final rejection, prior office actions, responses, and amendments.
  • Current claims, proposed claims, specification, drawings, and cited references.
  • Foreign prosecution materials if they affect strategy.
  • Applicant instructions on essential claim scope and fallback positions.
  • A signed power of attorney in favor of SODAM. An applicant with no domicile or place of business in Korea must act through a Korean patent administrator (Patent Act, Article 5).

Typical Stages and Deadlines

  1. Route decision. Within three months of service, choose re-examination or an appeal, decide on any divisional application, and request the 30-day extension if needed.
  2. Appeal brief. SODAM files the appeal with arguments addressed to the examiner's actual reasoning, supported by technical evidence where useful.
  3. Board review. The Board reviews the application. If it finds a ground for rejection different from the one in the decision of rejection, the applicant is notified and may respond (Article 170).
  4. Decision. The Board either sets aside the rejection, and may remand the case for further examination (Article 176), or dismisses the appeal, which opens the Patent Court and separation-application options.

FAQ

Is appeal always preferable after final rejection?
No. Appeal, amendment, divisional strategy, and abandonment should be compared based on claim value, rejection strength, timing, and cost-benefit considerations.
What strengthens a Korean appeal?
Clear technical distinctions, well-supported amendments, and disciplined argumentation addressing the examiner reasoning are important.
Can foreign appeal arguments be reused?
They may be useful background, but Korean claim language, procedure, and examiner reasoning must be reviewed separately.
